Some comments:
This is not actually a half-bad idea. Unfortunately, if alcohol is involved, consent becomes an enormous issue. So even if she presses the button, it could be useless because she's had at least one drink.
This app is a distant relative of the "always be recording" defense that men should employ under the right circumstances. But setting up recording can require too much in the way interrupting the moment.
The killer app would be a single button on the phone's desktop to instantly engage audio recording and then hide the fact that the device is actually recording. The app button would have to be something innocuous like "Elephant" (never forgets, and all). If there is any indication on the device screen that active recording is going on, then that also must be incredibly innocuous. Note: recording people (even audio) without their prior knowledge is subject to all sorts of laws that can vary from state to state.
EDIT: I have given this some more thought. Caveat - I'm ignorant about cell phone software operating system technology so I don't even know if this is feasible:
Most smart guys have their phones code locked. So an instant on button could only be accessed AFTER the code lock has been passed through. That negates the "instant" feature. However, perhaps the audio recording could be started by entering a DIFFERENT code. An error message would be returned, of course, indicating that it's the wrong code to unlock the phone. However, that's a custom error message which would also secretly indicate that the audio recording has started. The audio recording would be stopped by entering the that different code again.
Of course, if the app got popular, everyone and their uncle would know about it and poof! There goes the secrecy. Pity.

1.Put a breathalyzer on the app. If a woman goes over .5 it tells her "you're drunk" and then she must consent on her phone for it to go through.
