I have recently organized an event in a club with a guy(let's call him 'J') in my city. We promised the club to pull a sizable crowd and we were promised a commission on the bar sales by them in return for doing so.

The deal with the club manager was discussed in person and later I sent him a mail with the terms of the deal. To which the manager sent a mail saying that he agrees to the terms.

The event went exactly as planned. Bringing in the crowd as promised. I took care of all the publicity for the event single-handedly. Everything from advertisement to publicity to print.Now the thing about 'J' is that I have known him for over 6 months or so before organizing the event with him and he came to know me as from my work on YouTube. He wants to do what I do but is not technically as sound to be there. So there has always been this vibe of jealousy and insecurity within him. Which he even told me himself while being intoxicated.

After the event, 'J' started getting jealous as I was getting more deals as an artist since poeple responded well to my set in the night. 'J' started talking to me very rudely and unprofessionally. When I told him to procure the commision from the club which we rightfully deserve he tells me that we shouldn't be worried about the money and rather focus on organizing the events for the community. This is when I stopped working with him as he doesn't seem like the kind of guy who has the balls to talk to the club management for the money that is owed to him.

Two weeks later I go to the same club casually and I find out about his hypocrisy. The club manager tells me that he has already paid the commision to 'J' and that the 'J' has already collected the cheque from the club a week after the event was done and didn't even tell me about it. I called him from a different phone number and confronted him about it. He started panicking the moment he realized that I have come to know. He started saying he has to talk to the club owner to know what I have spoken to him. Soon after that, he cut the call in a panicked state. Now he is trying to avoid my calls and blocking me on WhatsApp, so I can't reach him.

I sent 'J' a text saying that there is no point in avoiding calls right now and that I know that he has picked up the cheque and that he needs to send the money to me or I will begin legal action against him next week. He replied 'Lol' to that.

Now I am thinking, whether to take legal action against him for the things that he has done or just let it slide and take it as a lesson for the future to never work with someone as low minded like him. Any advice is greatly appreciated.

Value of money can be a very subjective thing, so let's just say that it is not a lot to make a significant difference financially but still enough to go to have a legal case against a person. The problem is, like you said is I might not get anything other than the satisfaction of doing something about it.

Small claims court exists for a reason. No lawyers. Just a court fee. Make you you save those text messages, find witnesses. Check with that club owner who said they cut the check, they will need to be a witness. Also, make sure the owner is on your side or neutral, you might be suing his friend which will hurt your career and reputation.

I’ve been in business for many years and I would question some of the advice I’m seeing.

  1. Your goal is to do many deals over a long period of time and this is just one deal gone bad. It’s important to keep this in perspective. If it’s a relatively small amount of money then yes cut your losses and move on.

  2. Making a statement and showing the world what a douche he is can often be more difficult than your damaged ego is willing to consider. Spending weeks of your time and a significant amount of money to get a legal decision can be a huge waste. I’m in North America and know of several cases in my industry where contractors who weren’t paid went to court got a favourable ruling and still never got paid. We’re talking very large sums of money. So assess your ego. If that money went to strippers and partying and this dude doesn’t have any real assets... water from a stone and all.

  3. Limited energy to getting paid is totally fine. Getting a lawyer to draft a letter etc is a great idea. Just remember your focus is on the present and future.

  4. Violence is risky. I’m not sure what the risks are to using violence or intimidation are where you live but tread lightly. I’ve heard of people getting favourable results but consider the risks, it’s probably not worth spending time in prison. Also who’s to say he or one of his circle doesn’t kick your ass leaving you in a worse spot.

  5. There are two key lessons I’m seeing in your brief description. Firstly you partnered with someone who aspires to do what you do only is less capable. Second you didn’t control the money.

Honestly I would give this some effort to collect but not enough that it has any appreciable effect on your future goals.

Yes, I just spoke to my attorney. She is preparing a legal demand for the same. After this I will make it my personal goal to make sure that he doesn't get any deals in this industry. The industry is better off without people like him

Based on your posting it seems you are in India? I'm not familiar with local law, but in the USA having an attorney send a "demand letter" is usually very cheap.

Copy the email correspondence, screenshot the relevant communication. Have the club owner confirm in writing the amount of money in the check. Send info to local attorney. I don't have reason to believe civil law is different there. This is quick and easy to do and J will panic and send your half.

Yes you are right. I am from India. The law is a bit tricky here as it gets easily influenced by politics. A case begins with going to the police and filing a FIR (Report) and then after the police investigates it, it is forwarded to the magistrate. Based on what I have heard, this is where most of bribing and tampering with details happen. This is the main reason for me being a bit hesitant.

If you are from India, then I wouldn't waste time on suing him. Go for character attacks. Smear him, make websites that say shit about him. I can even make irrefutable photoshoped evidence of him doing nasty stuff.

I am in Europe and I do not think my country can provide legal justice let alone in India.

If what you are saying is true, you also have some additional options:

  1. Destroy his reputation. He violated a business agreement. Telling the truth about this will prevent him from procuring future business. Business runs on reputation. One action like this can destroy it for a VERY LONG time, maybe even permanently. The mechanics of this could be registering a domain name linked to his behavior and SEOing so if people look him up, they come up with his history, hiring someone to publicly shame him, which is done in Japan to collect debts, etc.

  2. Definitely never work with him again;

  3. Definitely sue him.

$5000 and under is nothing to go to court over. You'll spend more time and money on a lawyer than youll get back. Anything over, go to a lawyer spend a couple hundred on an hour for a consultation on what to do. Legally it really depends what country or Province/State you're in.

If you’re in America take him to small claims court. Cases are $10,000 or less. Don’t need a lawyer, don’t need anything crazy. Just go to court, fill out some documents, have someone serve him with papers, and your court date is set. You represent yourself, so keep all necessary documentation.

After you sue, I would go after each job he tries to get. You said you’re better than he is. Undercut him by a dollar each time. Even if your work is a lot better. Basically force him to move to another town. Do not let up on him. People like that do not learn their lessons quickly.
