Sexual assault can occur either forcibly and/or against a person's will, or when a person is incapable of giving consent. A person is legally incapable of giving consent if under age 18 years; if intoxicated by drugs and/or alcohol; if developmentally disabled; or if temporarily or permanently mentally or physically unable to do so.

So if she's intoxicated and you have sex. Its rape ! As I've been saying, and you've been denying.

So that means, if you're both drunk, whoever puts in a complaint.... the other party gets marched off campus as a rapist.

I don’t really understand how this is unique to “affirmative consent”. Even under the traditional “no means no” mindset, a person can be too intoxicated to consent. This is not new.

My thoughts are that criminal matters should be dealt with by the police and not these campus kangaroo courts.

There are 3 potential stories here:

The guy thought that he was sexually assaulted and reported it accordingly (his story).
The guy was getting revenge on her because she did the same thing to his friend (her story).
Or, the guy woke up and was afraid she would report him, so he reported her first.

In any case, all these stories show systemic problems with how the universities handle cases of sexual assault. The actual problem is that they shouldn't. Cases of sexual assault should always be reported to the law enforcement and should not be handled by private institutions outside of the law, because courts of law have rules in place which are meant to protect both victim and alleged perpetrator.

And all the feminists decrying his ability to report her with impunity "they were both drunk, both are guilty" is what the MRA's said near 10 years ago. So the shoe's on the other foot now.

This story has a lot less to do with who is right and who is wrong and much more to do with the warped sense of social status evolving these days based around social justice or social morality. The idea of social status is transferring from those who are powerful and successful, to those that are victims or help the victims.

See, if the university didn't lose or gain anything by dealing with sexual assault claims like this, they wouldn't bother with them. But suspending the girl, regardless of who's right or wrong, earn's the university some points.

I'm not sure if this comment belongs here and I am also not familiar with the ins and outs and nuances of the law. But does anyone have insight as to why one person can be found liable for sexual assault or rape on the grounds of no consent under intoxication when both parties are drunk? It is also my understanding usually it's the man found guilty but for this question I'd be fine with leaving sex and gender out of it.

I like the analysis that it is a "Prisoner's Dillema" situation where the two people are encouraged to "defect": do unto others before they do unto you.

It's not even really about "affirmative consent"but 1) the fucked up nature of the kangaroo courts that investigate Title IX violations and 2) the rules regarding drunken sex.

As a side show, it is just another example how women/feminists scream for equality. . .until they get it. Then they realize that being treated like a man kind of sucks given the system they created.

The race baiters have the same aneurism whenever a white guy sues and wins just to be treated equally.

Canada doesn't have this issue. . . or it has this issue far worse depending on your perspective, because s.15.2 of the Charter explicitly allows affirmative action programs; that is, it is legal under the constitution to discriminate and treat people unequally as long as it favours somebody with a historical bone to pick. . .all in the name of "equality".
