Swedish man acquitted of rape charges thanks to audio recording, woman sentenced for false accusation

Swedish 25 year old man had sex with a woman in a night club toilet; made a sound recording to be on the safe side; was later accused of rape but released thanks to the sound recording. Three years later, the woman was convicted (and sentenced to laughably small damages and fines) for false accusation.

Back in 2013 a 25 year old "Swedish" immigrant was out clubbing at a dinghy nightclub in Stockholm and met a 19 year old girl whom he took to the club toilet and fucked. They were both in a playful and good mood and neither was remarkably drunk. All fine and dandy and I'm sure you've all done the same (albeit fucking people in dirty club toilets might not be my cup of tea). After the act, she gave him her number and off they went.

Sure enough, the next day the woman goes to the hospital and claims to have been raped. The woman pointed out the man's Facebook profile to the police and the man's DNA obviously matched the semen taken as part of the rape kit. The man admitted to having had sex, but presented an audio recording which caused the police to drop the investigation even though the woman maintained her story despite being confronted with the recording.

Instead, the woman was indicted and subsequently convicted for false accusations. As expected, the sentence and thus the consequence for putting someones job, future and social life in limbo, was a laughable $1600 in damages and a $380 fine.

Now interestingly enough, the reason the man had recorded the encounter was because he "had a hunch that it would be best to record what was going on" and that "there is a lot of talk going on about men being accused of rape." Well, apparently his gut feeling was dead on and so should all of ours be as well.


  • Don't have sex with people and in places or situations that expose yourself to rape accusations

  • Cover your back, for example by an audio recording

EDIT So I got hold of the police investigation which confirmed most of my suspicions about what had gone on but wasn't reported in the paper. I guess you can extract a couple more RP truths out of it as well.

  • The sound recording is classified, but it has been transcribed by a police officer: “The conversation that can be heard involves the girl wanting to be fucked hard and the man confirming that. The man insists on going out to his car, but the girl wants it to happen where they are, or it's not going to happen. The girl moans, then the man moans. The sound of glass shattering can be heard and the woman says the man now owes her a drink. The man and the girl discusses whether he came or not. The girl says she wants to come too. The man asks for her number and she gives it to him.” The initial conversation is transcribed in further detail by another officer: "A female voice is heard saying 'fuck me', the man answers 'shall I fuck you?', the female says 'so fucking hard', the man says 'shall I fuck you? I want to fuck you baby'."

  • When the girl is confronted with the recording she initially says she “doesn’t want to hear it”. Later, she says during questioning that “she doesn’t recognise herself in the recording” and that “she can’t imagine herself doing such a thing.” She also says that “she reported a rape that she feels has happened” and that “it feels really annoying to be accused in return”.

  • The guy in question was a chubby immigrant with a turkish-sounding name who spoke Swedish with an accent.

  • The girl appears to be the all too common kind of lower-class girl from northern Sweden moved to Stockholm "in search of luck", i.e. going to clubs, blogging about her "posh life in the city" and trying to find a provider. Obviously, being banged by Apu in a club wasn't her idea of a good story to tell your friends, so when her friends found out, she went to the rape clinic.

  • The guy tried to call her the next morning, but she didn't answer. Instead, he called her friends (he had gotten their numbers too) and mistakenly mentioned that they had fucked the night before. The friends immediately became defensive.

  • The girl mentioned to the police that she has been raped once before (surprise surprise!), apparently when on vacation.

It's because of the relative importance of perjury over rape in society.

This wanting equal punishment isn't realistic. Having said that, I'm surprised the courts don't treat perjury as more important than most other laws, they tend to hold the reputation of jurisprudence as the main concern over all others.

This is correct, and why there needs to be a separate offence of 'making a false rape accusation', different from attempting to pervert the course of justice, or perjury (should it have gone to trial). This is because we hold rapists as being particularly vile, they serve long sentences and go on a sex offenders register, and should it come out later it is not regarded as something like burglary or car theft.

Therefore, what the woman is attempting to do to an innocent man is equally vile, and may indeed lead to him being raped (remember that more men than women are raped in America, when you include prison populations in that total). So the punishment should fit the crime.

The alternative is the islamic idea of wanting two male witnesses, but I think making her take his sentence if her lies had been successful is better and fairer. There very likely will not be independent male witnesses around in a real rape, so that unfairly acts against rape victims. Making an offence of false rape accusation is something that can be brought only against someone proven beyond reasonable doubt to have lied about being raped (as in this case).

Another case in the news is the woman who was arrested in Dubai of having sex outside marriage when she claimed she had been raped. It seems that the evidence was clear that she made a false accusation in that case, too.

Rape is legally unusual in that it oftens comes down to contradicting testimonies. given that the word of a woman has often been seen as enough to destroy a man's life, we should take measures to discourage knowingly false accusations that intend to exploit this lack of burden of proof.

PD's usually have a massive caseload and get very little time to spend with/on any particular prisoner ,, many of them are quite competent lawyers, they just don't get the chance to apply that knowledge

It's like asking any professional to "do the job" in a tenth the time it would 'normally' take -- it either won't happen or 'corners will be cut' (aka 'taking a plea' = a Lot of saved time for everyone, courts,cops and Public Defenders ---

But anyone who read the details could learn at the time that:

If it's illegally obtained (as is the case for you in NH), then it is not admissible as evidence. There are a few extenuating circumstances (such as recording the police) but most of them time they will not apply.

Admissibility of evidence is generally ruled on before a trial, rather than during. If the prosecutor is aware of the existence of exculpatory evidence and is still going for a conviction, they're well past the point of just 'stacked against you'. The law itself evidently reads like a "two party consent" state, but at least one Michigan court has ruled that since the statute talks about "eavesdropping", it's really a "one party consent" law because one cannot "eavesdrop" on one's own conversation (see the link).

lol, of course one doesn't mean the other. you can have power, and still get slapped.

what i meant. the unsung quality of powerful politicians, ceos, or what ever. is they have a good read on body language, and facial expressions.

its like a big poker game. knowing when to bluff, intimidate, call, or fold. when a man abandons his instincts, to adopt the external expectation of behavior. that external pressure, always tames, and makes the man a beta. the man that recognizes this current, but uses it, rather than being dragged under. becomes the captain of the ship.

more directly in terms of women. a hard core feminist i knew, who would rant about roosh v. also posted a meme to the effect of "don't ask her for sex, carry her to bed like a viking." the same woman, that felt the need to stamp out any violence against women, would fantasize about being "taken"

when you follow the common assertion that females are wholesome, and morally superior. you turn off your very instincts that would lead you to romantic success, out of fear of punishment. how ever, making yourself the best version of your self, while fine tuning your instincts, to know when and when not to act, will elevate you above the system.
