Get the bank statement from the account going back months to see who, when and where withdrew the money / spent it. If it was spent on bills there will be an electronic record (no one pays bills by cash). She's lying...you know it, we know it and she knows it...and pretty soon a judge will know it too. Make sure you pursue this fully, and get what you are owed.

Man that’s so messed up. I keep hearing horror stories of dudes leaving their money in joint accounts during divorce and their wife just cleans them out with zero repercussions. Good luck man.

I’m in the same boat. We had about $20K in a joint account. After I was told to leave the house she started siphoning the money into her personal account. Fortunately, I have her on record stating this and acknowledging that half of that money is mine. I think that will help me get it back from her.

Include it in the cost of divorce and move on. You're never seeing that money again.

In Canada, we have something called Net Family Property. It's when we look at all the $$$ and figure out where the money is and where it goes (more complicated than that obviously). I'm not sure which region you're in, but did you do something like that?

Did you hire a lawyer to help you with this?

No. You have your lawyer file a motion to compel your STBXW to disclose through documentary evidence where this $25k went.

The first question you should really ask yourself is: "Do I really need that 10k?" Is that 10k worth the extra time having to interact with your ex, having to sort out courts, solicitors, etc?

If the answer is yes, then when you had mediation, you should have both provided up to date statements showing values. You also know how much monthly outgoings were. You haven't given a time frame between the agreement being done and now, but even if a year ago, that is 2k a month, which seems high... So, she either siphoned the money and is going back on what was written in the agreement, or she lied when doing mediation. Both of which are easy to prove.

You say you are waiting for the statements, which sounds like you don't have legal counsel? I would recommend hiring someone if this money is that important, as she could doctor the statements and you wouldn't be able to tell. If the account is joint though, and your name is on it, just go to the bank and get the statements direct from them.

If the answer to my first part is no, then just leave it. 10k is a small price to pay for your freedom.

If this isn’t a lesson idk what is. I had a girl I dated for a year and she really badly wanted to put our money all in one account to the point where we got into a fight over it. Mind you she worked part time and I was a welder so I would contribute tons more than her. She had 3 kids on top of that so they all lived with me. Anyways she talked me into getting her a debit card on my account. 1 week having it she tried taking out 500 and the bank called me. That broke us up. Never again.
