Generally speaking the date that you file is used to determine the end of the acquisition of community assets or community debts. So anything that you do after as, long as you didn't use community property to generate it, should be yours.

Mine was separate after we filed and had an agreed to separation date. A date that we were actually separate (sleeping in different rooms at the time). If we had strayed back together or did not agree to that date, the date could have been argued or restarted. Make sure to document how you've already been separate in case you need to prove it. Congrats on the raise.

Anything acquired After the separation date is not considered communal property.. key word here is separation date, not when to argued not when you left. You need to be clear on separation date. Mine is stated clearly on my court documents.

I asked my lawyer a very hypothetical question which I hope answers the question.

suppose I won the lottery post separation . He said my STBX would have to prove that the money you used to purchase the lottery ticket was from a joint account you shared.

So dont do acquire anything using funds that she can lay claim until your divorce is final. That's what I'm doing

That depends on the state. Some like CA as pointed out below will draw a line at date of separation but others like TX don't really recognize separation and consider finances joined until divorce is final.

In Massachusetts there is a hypothetical ability to attach anything up to the date of Divorce Nisi, as my ex’s lawyer gleefully pointed out when he explained how he was deliberately dragging out the process in hopes that I would generate more assets. So a 3.5yr marriage gave rise to a 2.5yr divorce process. Practically speaking, Massachusetts courts can be a little more lenient but there is a legal claim someone could make.

This is a state dependent issue and you need to consult your attorney about it ASAP.
