The act of setting fire to an LGBT rainbow flag in Ames, Iowa, in June 2019 did ultimately result in Adolfo Martinez receiving a total sentence of 16 years in prison.
What's False
Several news articles failed to mention that Martinez' sentence would not have been nearly so long if he had not already been convicted of two previous felonies and treated as an "habitual offender," in keeping with Iowa state law. In that circumstance, his criminal history tripled the maximum available sentence for arson from five years to 15 years.

B) I'd have thought that the maximum sentence for any given crime should be reserved for only the most extreme examples of the crime. In this case, that would mean arson resulting in hundreds of thousands of dollars worth of property damage. Dude burned a FLAG.

A cop once told me pot is illegal and heavily punished because it is easy and it helps get bad people off the streets. The theory is, if you're willing to do years of hard time for something pretty worthless, what else are you willing to do? The pot allows them to catch you in the act of being a fuckup, instead of try to catch you in the rarer but common act of doing bad fucked up things that fuckups do.

What you're still not pointing out however, is that he was sentenced to a year and 30 days for stealing the flag and dangerous use of fire based on his priors which was reasonable. And sentenced 14 years for burning the flag it self by labeling it a hate crime.

Unsure if this is comparing apples to apples. I followed the story in Indiana quite closely. I penned a letter to that young woman. That was an intensely tragic event for everyone, including the woman driving the truck. This hits close to home as I was involved in a similar incident in the same role as this woman.
She was terribly negligent, that is certain. She saw the flashing lights and dismissed them as construction, then continued on at a high rate of speed. She was grossly negligent. Frankly, the amount of time in prison will never compare to waking up every day of her life knowing what her negligence did.
This guy sounds like he has been quite the troublemaker. "16 years for burning an fag flag" is misleading.

The Indiana woman was given a lighter sentence due to the fact that she had a clean criminal record, she is rather young, and she is a mother.

The Iowa sentencing seemed to have less to do with the LGBTQ+ community than with the arson itself (I’m fact, CNN states that the LGBTQ+ advocacy group said that they appreciated the strong effort towards justice but they would have chosen a lighter sentence that was more focused on reconstruction). The man had a heavier sentence because he was a repeat offender, having committed two previous felonies. Under Iowa law, that increased his sentence from the normal 5 years for arson to 15. Not sure what the 16th is for. I read an interesting snopes article that really defines the state law as it pertains to this case.
