Being a private school, it's always been trivial to remove due-process protections from accused students because accused students have no due-process protections when it comes to private organizations.
Do they take government money through loans? I don't say it's right to do this and I don't say it's wrong to do this, but I do say they do this: the federal government oversees and regulates all sorts of private-business behavior through such businesses' access to federal money.
The federal government could enforce due-process protections for the accused: they just won't.
Oh, so you see this as a better situation, then, insofar as the institution can't hide behind "We're just following orders" cop-outs? And you think it makes it easier for injured college men to sue Duke and others? Is that it?
