A Michigan father in a private Facebook group writes about a the mother of his child and his ex wife who has made false allegations against him, has allegedly killed his animals, spied on him, stalked him, beat him, stabbed him, stolen from him, neglected his child due to alcoholism, and generally endangered his child. Legal expenses are bankrupting him. He concludes "I just want to be a father to my son"

Here is my reply, in hopes that it may help others who seek justice:

I am not a lawyer and this is not legal advice.

Seems you are alleging you have been discriminated against on the basis of your sex as a victim of domestic violence.

First I would maintain excellent documentation. I would attempt to use witnesses. I would consider if I should record all interactions.

All victims have equal access:

"No person in the United States shall, on the basis of actual or perceived ...sex..be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under [VAWA]"

If I were you I would consider a protective order including supervised drop offs at your abuser's expense.

I would also consider a lawsuit against the agencies involved for:

42 U.S. Code § 1983 - Civil action for deprivation of rights

https://www.law.cornell.edu/uscode/text/42/1983

I might consider a lawsuit against my abuser and her co-conspirators for intentional infliction of emotional distress.

To constitute depraved indifference, the defendant's conduct must be 'so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime.

I would recall everything I told the professionals involved in my case regarding my child and the threats to my child by my ex. Ignoring child endangerment because the perp is a woman may be a crime:

A person who, while engaged in a professional capacity or activity described in subsection (b) of section 226 of the Victims of Child Abuse Act of 1990 on Federal land or in a federally operated (or contracted) facility, or a covered individual as described in subsection (a)(2) of such section 226 who, learns of facts that give reason to suspect that a child has suffered an incident of child abuse, as defined in subsection (c) of that section, and fails to make a timely report as required by subsection (a) of that section, shall be fined under this title or imprisoned not more than 1 year or both.

18 U.S. Code § 2258.Failure to report child abuse

This could amount to a de-facto conspiracy to kidnap, because the secret goal of the professionals is to maintain mom as the primary caregiver, regardless of dangers to the child. As such, the conspiracy of silence regarding those dangers may amount to a conspiracy to deny dad primary custody, and may be a conspiracy to kidnap, which may be racketeering:

(1)“racketeering activity” means (A) any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, dealing in obscene matter, or dealing in a controlled substance or listed chemical (as defined in section 102 of the Controlled Substances Act), which is chargeable under State law and punishable by imprisonment for more than one year;

18 U.S. Code § 1961.Definitions

https://www.law.cornell.edu/uscode/text/18/1961

A conspiracy to maintain mom's custody while the child is endangered may be a conspiracy against the child's civil rights to safety:

safety, sanitation, and protection of civil rights

https://www.law.cornell.edu/uscode/text/42/671

Any conspiracy against the civil rights of the child or father in which any official collects any money or allows child support to flow to mom from dad as a result of the conspiracy may be a conspiracy to defraud the United States, which funds child support and other activities through Title IV-D and Title IV-E:

If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both.

18 U.S. Code § 371 - Conspiracy to commit offense or to defraud United States

State child support, parenting time, and child protection are all primarily funded under federal law Title IV-D and Title IV-E. Consider filing complaints.
