Let's be honest.

You can murder ANYBODY in Texas with no witnesses as long as you say they were reaching for something (with the implication being that it was a weapon). I seriously doubt this naked boy was reaching for anything.

Bottom line. Girl was scared. Didn't want to be called a ho. Called false rape. Dad gets away with it because you can murder anybody in Texas if you say they were reaching for a weapon.

Dad is blue pill. Believes NAWALT. His daughter, in his mind is a magical unicorn and not a ho. His daughter could NEVER be a slut.

As for the father being in the wrong shooting the kid, i'll share a popular anecdote I learned in the military.

'You don't rise to the occasion, you revert back to the level of your training.'

I'm guessing the dad wasn't some SEAL, MARSOC, or CAG operator so I am going with the assumption he has a baseline level of firearms training. Meaning he can safely load, unload, discharge, and clean the weapon. He knows the five basic safety rules, and keeps his gun locked in a safe. It is unknown if he has taken further classes on tactical and self-defense shooting ran by civilian contractors, or if he has any military experience relating to advanced combat marksmanship and defusing potentially hostile situations in a kinetic environment.

He does not look physically imposing, so his experience in Martial Arts may very well be nil. I cannot agree with the people that advocate the father should have engaged in a physical, hand to hand altercation with the boy. I believe that to be pure idiocy. To surrender your firearm and try to 'duke it out' like this is an 80's action flick. No thanks. The firearm has a self defense tool is designed to be an equalizer. Giving the means for the less physically inclined to be able to defend themselves against a motivated, stronger aggressor.

It is a tragedy, no doubt. I sympathize with the boy's family. The main culprit is the daughter for failing to positively identify the boy and informing her father that the sexual encounter is consensual.

Firing a warning shot at the ceiling? No one does that. What if it wasn't some kid looking to get his dick wet and it was an actual rapist? Imagine the firearm jamming. You just gave the go ahead for the stranger to rush you. Not to mention pointing the weapon away from the man and onto the ceiling, after which you have to bring your weapon back down and reacquire your sight picture and align your sights again. A precious second or two wasted. Furthermore, It most likely did not occur to the father to do that. Telling the suspect to keep his hands up and back away from his daughter? Once again, you don't rise to the occasion, you revert back to the training, of which the Father had but the most basic. I can empathize with the father; seeing a strange, uninvited man in his house in close proximity to his daughter who is also claiming she doesn't know. He most likely had tunnel vision and did the only thing that came natural to him at the time due to his level of training and information given to him by his daughter - acquire target - get good sight picture - line up sights - squeeze the trigger.

I honestly can see myself doing the same thing if thrust in the same situation. It's easy to theorycraft happy endings from unfortunate events on the internet. I am happy the man is not being indicted, but I think the daughter should be given a harsher punishment than mere guilt she will try her hardest to hamster away.

I know this opinion will be unpopular but I have been in violent armed confrontations before and you don't think. You react based on your training. You get tunnel vision. Auditory exclusion. Time slows down. Your body gets a dose of the 'chemical cocktail'. I'm sweating as I type this, trying to remember and refamiliarize myself with the sensations i've experienced in the past. Seeing a strange man in your house in the dark 'suddenly move', even for his boxers is definitely a precarious situation operating on your limited and untrue intel provided to you by your daughter and your limited time to accurately assess the situation. You can't pause this like a video game. A man who doesn't make a decision is a dead man. Not to mention you're hyped up on the chemical cocktail and a fair bit afraid yourself. It sucks, but I can see why he squeezed the trigger.

I'd say that this counts as manslaughter. Whether the guy should see significant jail time or not is questionable and I don't have enough evidence of either side to make a clear judgement on the matter. This is just an unfortunate occurrence no matter which side of the story you're on. The father is going to have this on his conscience for the rest of his life.

At first I got the impression that the dad was guilty and too trigger-happy. Then I put myself in his scenario - waken up by my boy in the night, telling me that there's a man in his sister's room. Go there to check it out and yes I do find a guy in her bed. I ask my daughter who he is and she tells me she doesn't know. So I have a gun in my hand and am informed that the guy from my daughter's bed is trying to rape her - well, I would have emptied the gun in him.

The guilty here are the two persons in the bed (one more guilty than the other). One has payed with his life for doing a typical teenager mistake, the other will get away because pussypass.

This has nothing to do with RP or anything.

Teenager lied stupidly and the father was confused/threatened and the other teenager made a sudden movement he didn't expect and he pulled the trigger. The father was still trying to verify the identity when the boy made the sudden movement since the father was arguing with his daughter about it.

This is just tragic all around.

Also, this is in Texas. If somebody breaks into your house, especially at night, you can legally shoot them as long as you meet certain technicalities like the intruder making a sudden movement toward the homeowner.
