If the victim doesn't criminally charge the perpetrator report the crime within the time frame of the statute of limitations, then legally there's nothing to criminally prosecute because no investigation happens, and thus the perpetrator is never charged with a crime. This is old enough that there probably can't even be a civil suit at this point. This is how the law works. Edit: Clarified for the pedant.

No. Satire doesn't require drawing a person with exaggerated racial stereotypes. As I've said four times now, the problem with this cartoon is depicting Williams with imagery used from the Jim Crow era and prior. He could have drawn her in a million different ways, but he did it in a way that depicted that imagery. It doesn't have to be a political statement to be racist. Simply drawing someone with exaggerated racial stereotypes is all that is required for the picture to be racist. My specific point is that you can draw an unflattering caricature of a black person without making them look like a sambo or a pickaninny. The artist of this cartoon failed to do that.
