Not sure about New York, but here in Maryland she could be charged with Breaking & Entering in the 4th degree. No, you do not have to actually break anything or use tools (crowbars, lock picks, etc) to get in. You just have to enter without permission (just jiggling a doorknob to see if it’s locked is attempted B&E). It’s a misdemeanor, 1-3 years. It’s really the only B&E charge they could get her on.
