You make "rape" just some punishment for having sex with someone who is legally not allowed to have sex just yet then actual rape gets trivialised as just a quirk of the law.

Not sentencing minors as adults is almost always the best case of action and I don't disagree with that nor did I know America dealt differently with those cases. But it does seem like something needs to be done in regards to her, she's killed a random passer-by in cold blood and then apparently (according to the other comments) bragged about it on facebook.
