Texas is one state that doesn’t do ATROs on this stuff so that makes sense. Your spouse would have had to request standing orders prior to you removing her afaik. This is not the case in many states though. Readers beware and make sure to check for your state!

As mentioned on your other comment - being technically able to do it is different than being legally allowed. Now, your ex would need to push for legal action and the judge would have to agree. But that is what you open yourself up to.

Your health insurance company or employer aren’t going to stop you - why would they? They aren’t in the courtroom and divorce court orders aren’t forwarded to them. Instead it opens you up to contempt of court and potential legal action by your ex. Look up status quo orders.

It doesn’t depend on her employer. It depends on the state where the divorce was filed. If that state (eg NY, CA) automatically apply temp orders on these things then you can’t change. Otherwise you can but it’s still precarious.

I’m “winning” but still feel like compliance is a joke. I’m jumping through a million hoops while she hasn’t addressed a single court request (eg installing OFW or getting a drug test - 4 months in), took my kid outside the country in direct violation of a court directive and without my permission, and still… nothing. Right to Due Process - Fifth and Fourteenth Amendments. In particular the Fourteenth once these orders, when done ex parte, lead to infringement on life, liberty, and process when not ensuring procedural due process occurs in reasonable time. Let’s not forget a trampling of constitutional rights given most courts are backlogged so you end up potentially going months without any evidence having to be shown. Honestly, it’s cowardice.

10000%. Started dating a woman shortly after I left the ex and she flipped on me at one point and implied it wasn’t possible for my ex to have abused me. That’s when that relationship died even though she did come back later and apologize for not checking her priors.

This isn’t right at all… but you also have to have invested in those other relationships for them to be able to support you when needed. You can’t just show up and dump on people.

This is exactly what I was reflecting on today - there’s an inherent assumption that you must have done something to warrant the craziness. I don’t blame others - that would be my reaction, too. Thankfully I’ve got a bunch of folks who know me incredibly well and have seen some of it first hand. And a therapist that did couples counseling for us and has been pretty harsh after the fact with their critiques once thing ended.
