I think it’s purely down to incompetence. The 2003 Act has been heavily criticised (see R v A [2005] EWCA Crim 3533, [2006]) for being incredibly poorly written. Section 4 which brings the equivalence for rape for a woman even bundles in 2 separate offences, if the act is non penetrative for example, when it should be all be separated out. For whatever reason when they amended the law they decided to create a new offence, rather than ammend the existing definition of rape. It’s wrong to say it’s just a sexual assault. Its not (see section 3).
