Do what you gotta do man - I wasn't arguing nuanced cases like yours. I just think the new people here need to be reminded that this isn't the first and only option. It's not the movies, and it does seem like that's the first thing that people think they have to do - even though doing so will make it immediately contentious, and then you're locked in. Not sure why that should get any blowback at all.

I understand in this sub there's a lot of brutal divorces, and bitter people. I'm one of them, I'm just reminding people that it's the exception, not the rule - only around 2-5% of divorces ever see a day in court.

Some of these posts man - I think we need to normalize the idea that 'lawyering up' should be a last resort. Where does the idea come from that that should be the immediate response when someone asks for a divorce? Not all divorces are contentious and require litigation. In this day and age, where 50/50 custody is spreading pretty rapidly as a presumptive, and judge's getting less and less authority to split the finances too far in one direction or not - it's just a waste of time and money. The …

its all just been negotiation responses, and the attorneys emailing and calling eachother. That's why I had to cut it off - negotiating at this point is going to be more expensive than litigation. We'll see what she does, im hoping everyone is just exhausted - this is ridiculous.

It sucks man - as mad as I am at her for this, I've known her for so long, I know she doesn't handle stress and decision making very well. She relies very heavily on external influence and consultation. Unfortunately, it's kind of her attorneys fault for not advising her, and telling her to 'keep going until you have everything you want.' So she does. Nobody will tell her at this point that 'everything you want' isn't what divorce is about - and it's impossible. If you value limiting my time wit…

its not over demonizing, the meeting was to allow us to speak to eachother with attorneys present - and her attorney took over the meeting and escalated tensions that fired up my wife; and if my wife has mismanaged expectations, it's because her attorney hasn't given her the information

Possibly, I haven't been made aware of this being a requirement. It was proposed to me as completely voluntary

its collaborative, no arbitration - I think that will be my next pursuit, though

Im not sure if theres any preparation on my part - they know the terms, there's really nothing for me to contribute. My attorney said she is going to handle it. And no, the courts aren't involved yet. This meeting is basically a last ditch effort to settle before we're on a court path

It's not mediation - mediation failed when she changed her mind on 50 / 50. This is the 2 attorneys, myself, and my wife. And thanks, I'll try to breathe. It just feels like such a waste, and catastrophic loss of so many things to take this to court.

I think it was the fact that my wifes attorney put "on the same page" in quotes. My attorney should be very clear that it's 50 50 or I torch financial agreement to take her to court; she doesn't have a lot of wiggle or she's fired.

We do lots of that, too - it's winter so it's a lot more sedentary than usual

It's complicated, more unreasonable than you might imagine. She insists that she wants the house, which I gave to her along with almost a quarter million in her favor in the proposed settlement to account for her 250k in school loans. She burned the agreement to the ground, said she won't do 50 50 under any circumstance all of a sudden, after she's the one that initially proposed it. The house isn't suitable for him, regardless - currently all the bedrooms and bathing utilities are upstairs, so …

Academically he fairs poorly, and has since kindergarten. I suppose they could try and make the case that it's because of video games, but I had him assessed and he was diagnosed with severe ADHD, that she refuses to medicate. I think its a better case that his academics are poor because of a medically diagnosed chemical imbalance, rather than video games

Not to mention, my son is terminal and won't survive long into adulthood, statistically - I think you'd be hard pressed to find a judge that would remove time from either parent

It's worth a shot - the problem is she's lying to her attorney, and I'm not entirely sure if the motivation is financial if she wants to throw away a financial settlement that she would never get in court. It doesn't seem to be about 50 /50, beyond the fact that it's the one place I dug my heels in. It seems to be more about me not getting what I want more than anything else. Her attorney has stated that she's willing to do anything 'approaching 50 /50' but not 50 50. Basically, I won't settle f…

It already is - because of her student loans, she can't refinance it on her own - she dropped me like a bad habit a month after she got a job making a similar income. The house was part of the financial settlement, where I agreed to sign over the deed and gave her 3 years to refinance it, since I can buy another home anyways. It's pure insanity, and her attorney is still pushing her into court. It's completely unethical

I had been placating her during mediation to keep things calm since we were in agreement on everything, up to and including 50 / 50 custody - so you can say I wasn't out to ruffle feathers. Nobody, including either attorney expected her to change her mind at the end, considering I agreed to a half a million dollars in her favor in our financial settlement, and her being sacked with 260k in student loans (that I didn't benefit from in any way, and supported her entirely in her pursuit). Equitable…
