First of all - Everyone is entitled to the presumption of innocent until the the prosecution has proven their guilt to the appropriate standard. Matters of guilt and innocence aside, the defense's job is to act as a system of checks and balances to ensure that the prosecution meets that standard, that their client's rights are upheld and that due process was followed.
