Here in Colorado, if a Common Law marriage is deemed by a court, a divorce is necessary for a legal separation (this is not true in other states where Common Law marriage dissolution is legal). In order for a Common Law marriage to be recognized by state courts, there needs to be a preponderance of evidence suggesting that both parties explicitly agreed to the titles of husband/wife (or spouse/spouse in cases of same sex unions).
