Not that it makes a difference from a legal sense, but biologically it is relatively difficult for a female to transmit HIV to a male through traditional intercourse. Of course that shouldn't matter as far as prosecution, sauce for the goose is sauce for the gander as the risk does exist, but transmission just isn't as likely.
