What state are you located? How many kids are under 18 years old? What college funds (ie - 529Bs) do you have set up? This is most likely going to be going forward using lawyers since you cant figure it out in mediation. Thanks for the response. Cook County and it is downtown. The house thing is what sticks to me the most. I would not see the money for 3 years. Since I am on that mortgage- there is no way I am getting another with no stable income. And the liability portion- that’s messed up. For next 3 years, STBXW would pay mortgage and taxes 100%. But she gets 100% credit on that amount upon sell net profit. And who is to say that she will even sell in 3 years?

New attorney recognizes the inequity decision made by judge at pretrial. Said 1) the judge is using their discretion very heavily, 2) “not following Illinois state law” on the $200k withheld for college- even though kids have $200k in 529b’s, 3) STBXW has more than enough money to buy me out of the house right now or get a new mortgage and 4) we most likely will be going to trial.

This is why smart glasses will save you in the long run. It will record every action and reaction. Record everything you do with the kids: homework, driving, bedtime stories, making food, etc. that way she can not claim that you are an absent Dad. I have said this and will continue to say this….do not leave your home if you are an owner or co-owner. Especially if your wife cheated on you. You lose leverage in the divorce proceeding. It may be uncomfortable but your spouse has the option to leave as well.

Do you own a house or rent? If own, do not move out while going through divorce proceedings. You lose leverage then, really your lawyer should confirm that. As for therapy, after she dropped the D, I agree with others that it is a waste of time and money. Therapy should have been handled before serving papers if she was really serious about it.
