because what else is there to say about it. it is a largely uncontroversial US custom that almost no one ( men) cares about to try and stop. its not an issue of rights, anymore than piercing baby girls ears is. parents have the right to exercise control over their children's bodies to an extent. if FGM was a us custom for 200 yrs that would be legal too, but its not. people who oppose it should work to end the practice, what else is there to say?

well yes, sometimes. intoxication is a defense to many intentional crimes, battery however is not a specific intent crime, so the intent or scienter arent negated by intoxication. there was simply not evidence to support a rape charge under the statute. not all icky occurences amount to crimes
