Firstly, I never said he wasn't. Secondly, because the case wasn't provable. She had a positive rape kit done (damage, no semen). There was no doubt in the police that she was raped, but there wasn't enough evidence he was the actual rapist. The photos were not found and the only evidence that he was the specific person that did it was all circumstantial.
