| 1 | Can someone in the comments explain how this works?I was going to say that it depends who initiated the sex. If Jake asks Josie for the sex, then Jake would be raping her. But if Josie asks Jake for the sex, then Josie would be raping him. But, they're both drunk and shouldn't be held responsible for their actions. If Jake already knew Josie was drunk and willingly asked her because he knew she'd be stupid enough to so it while drunk, that's rape.
