It's being implemented to balance out previous inequalities, so as long as it's institutional it's not considered racist. Now, whether or not it's effective is debatable, as are specific situations where it's being employed and whether it's being employed correctly. IANAL, but I think lawsuit sums are often determined not by the magnitude of the transgression, but by how much money the defendant has. No, that is completely wrong. It's for damages incurred. Now, the amount sued for is often as high as they can make it, it sounds like in this case the class action suit is claiming damages to the amount of 31.9 mil.
