They claim it may have been spiked ie. No tox screen or they'd know for sure what they were on and if it is indeed one of the many date rape drugs and not something recreational like bath salts. It's just as likely that they may have taken the drugs willingly and then used them as an excuse for their actions later.

No there's a separate charge for attempting to hire a hitman, attempted murder would be of the hitman accepted the contract and failed, they could both be charged as such and murder of the contract is completed. This is a bit different since the "hitman" had no intention of actually doing it, and aided the councillors so his charge would be lowered including providing recordings, which isn't something anyone who is into contract killing would do.
