aww. what we will probably end up doing is ill buy her out of the house. we have only owned it a couple years and the market is shit. so no one is walking away a winner selling it and she doesn't make enough to pay the mortgage but I do. then my daughter will live here and we will split her school costs and have some sort of custody arrangement. if that doesn't happen and we end up selling the house in a terrible market ill definitely remember about keeping the house money to pay the CS.

i will say this about the lawyer i spoke to today. she basically said you guys are too poor to have long drawn out divorce and you need to convince your wife of that

That last sentence is definitely a key in all negotiations. the contested divorce thing is always a possibility but the money just isn't there. and what money is there is kind of balanced on the edge. like the house is not worth much more than we paid for it. and we've only owned the house 4 years. which is why the lawyer suggested working out an uncontested divorce. what will almost certainly happen is ill take out a equity loan to buy her out of the house because she can't afford the mortgage.

unfortunately no fault is the case. lawyer strongly suggests doing an uncontested divorce as any money we have will be eaten by the procesa.

sounds like a good idea. i am not retaining a lawyer immediately though divorce is the only option I see happening. i forsee this either being over and done with in a month or the actual crazy option where she accuses me of stuff
