What you're saying is valid, but in today's social climate, sometimes it's very hard to discipline certain students because of their parents. The girl who was screwing around on her phone might be a shithead whose parents will make the teacher's life hell if she tells her to stop doing something. If this were a pattern of behavior with many female students, I'd get it, but with n = 1 it's hard to say.
