As it is said, if you are going to kill someone, or seriously injure them, do it with your car. The law is hamstrung with maximum available sentences in these cases. The judicial system actually gave her what they could. Maximum/Minimum sentencing is what needs to be looked at.

So she threw her phone across the room at him (Most people couldn’t make that shot with any force) which struck him in the head causing a minor laceration (3 staples). No previous criminal record. No history of abuse or complaints of abuse from her partner. The judge enquired if she could afford the bond to be released, which she couldn’t so he allowed her to go free on her own recognisance. I can understand, but she was guilty of distracted driving that resulted in a single persons injury, she immediately turned herself in and admitted guilt. Other than this one incident she had never been in trouble with the law before and had no driving infractions. The boys on the other hand were at this sort of behaviour every weekend, and finally caused the accident. I don’t think the woman, nor anyone for that matter, deserves jail time for a one off incident completely out of character.

I don’t think you can compare these two incidents directly, one was caused by “distracted driving” the other was caused by “street racing”. The boys were already doing 60mph in a 30 zone, as well as other dangerous “stunts”. All in all they faced 8 different charges. As the adage goes, don’t break more than one law at a time.

You seem to be giving carte blanche to drivers to hit motorcycles and face little to no consequences because “they are harder to see and they take the increased risk by driving non-sedans” You probably believe a car side swiping a motorcycle for splitting lanes isn’t at fault either, since it was dangerous behaviour. The unfortunate matter is, cars may as well not have mirrors for how infrequently drivers use them.

The judge hasn’t a clue about medical science, so they would have the coroner present evidence on the likelihood of the heart attack being caused by something. In this case the coroner could not attribute the injuries to causing the heart attack.

Crime was committed in Western Australia, where the normal sentence is life imprisonment (parole after 10 years) She did 20 years, so the judges reasoning is she already served the sentence for both murders and offered the deal for the closure of the family involved.

Which is why it was 12 months and not 6 (which is the normal sentence for common assault in the UK) Common assault carries a maximum penalty of six months in prison and/or a fine. A person charged with a common assault first offence is likely to receive a fine rather than a custodial sentence. So given it’s first offence and she received a 12 month suspended sentence, she was already punished more than an average person would have been.

Would you be happy with them selling the Heroin they were trafficking on your street? To your family? Was it a fitting punishment for the crime? In our eyes, of course not. But this is their country, they advertise their zero tolerance on all flights to the country and on signs as you enter the country. These people knew what they were doing and the risks involved.
