Actually that's not universally true. In a lot of places, cars only have to yield to pedestrians who are legally crossing. Of course, if you see a pedestrian - or any other road user - failing to yield to traffic and you deliberately hit them, that's bad.

the test isnt whether it can appear, the test is whether there is a present ability to conduct the harm. if its not in her hand, or showing at that point, there is no present ability. I beg to differ. If I threaten to shoot you but don't obviously have a gun on me, it doesn't make it any less serious of a threat - in the US anyway, since guns are in such large supply.
