Someone else pointed out that I may have been mistaken about the no molestation. She did actually hug him and kiss him on the cheek before proposing sex. I'm not sure of the legal definition of molestation, though. If it includes touching in a way that could lead to sex or just is vaguely inappropriate, then that would count as molestation.

I don't think statutory rape cases of this nature are treated the same as aggravated rape. But I also think that it's not the student's age that is most important, it's the teacher-student power dynamic.
