I can also build in a clause in the MSA that if she fails to pay me 3x then she must sell That's still a huge risk...it's not so simple if she decides not to play ball. Nope, not at all how it works. They're both on the lease and if one person violates it, they're both jointly and legally liable for the violation. If that were the case, one could only partially pay rent, point the finger at the other claiming, "they're the one not paying! Evict them!" Never give discretionary control to a narcissist this will always be the outcome. You need to file for a modification to the parenting time portion of the divorce judgement and explicitly define what days/times you have the kids including holidays/birthdays, etc.

Contact your landlord. If he is exceeding the allowed visitor stay length, the landlord can have him removed. Your wife my also be in violation of the lease terms and he may begin eviction proceedings against her. Careful with this. Landlords will evict everyone, not just one person. They're both in violation, not just her, and OP will end up with an eviction on his credit too.

So, honestly, that may not matter. It's going to really really depend on how your local court typically handles cases like yours, down to which Judge you get. The only way you're going to get a factual idea on what divorce is going to look like for you is talking to local attorneys that have years of experience with your court and how each Judge typically rules. I'd highly suggest you get as informed as possible before doing anything.

Married 20 years, last 3 as a SAHM, that's a fairly risky position to be in. While courts generally expect the other party to find employment, that's not always the case and you could be expected to pay for her to re-enter the workforce. Lifetime alimony is a concern too for a marriage this long. All of it is going to be highly dependent on how your local court tends to handle such things. You REALLY need to consult with a few (yes, a few) attorneys regarding things before proceeding.

Fuck, I'm sorry man. Mine did the same, she fled 250 miles with the kids to the other side of the state and lied to get a RO. I got lucky though, thankfully, I filed here immediately and the Judge held an emergency hearing then ordered her to return the kids and drop the RO. It took me about 18 months and 60k, but, ultimately got full custody. Def wishing you luck bud.

One thing I don't see mentioned here. You need to get an attorney wherever she fled to and challenge the TRO she obtained. There's a very good chance you get it thrown out as Judge knows nothing about either of you and even with the simplest claim they'll issue it out of precaution until it's challenged.
