in your argument the only way for him to be charget for "retaliation" will be to admit she assaulted him first, if there is no assault it cant be retaliation, also retaliation (now this is in your argument) now under domestic violence this would only proceed as self defense because there was proof right on that moment that she instigated him to act againist her, you cant tell me she expected him to just take it, no actual lawyer will be able to sell it otherwise
