Therein lies part of the problem with divorce among other things. When a son or daughter is toxic, untruthful and manipulative, they can have their greatest enablers right at their side to advocate for them, pushing their toxic stories and lies, helping them have a sense of credence. “No, my son/daughter would never do that, they’re good kid(s)”.

This ⬆️ Mental and psychological abuse, brain washing, gaslighting and other tactics these boys experienced likely left them believing their accounts of what happened were real. Doesn’t mean they wouldn’t have played this out in their heads over the years and been extremely conflicted over their very own statements. Not sure about the US but in Canada mediation is a non-binding, without prejudice, procedure. This means that any and all things agreed to in mediation have no teeth…they do not need to be enacted by the party that agreed to the terms. In short, it can often be a waste of time and money, not to mention the mental strain of hoping and expecting the other party to act in good faith with no recourse when they don’t.

Ideally, since it is a plan you’ve both agreed to, the courts would implement the plan in a court order and you’d both be held to its parameters. Having said that, and many may agree with this, a court order being broken by a mother is nothing new (I’m sure fathers do it as well, but 80% of the time in family court the mother is designated as the custodial parent) and more often than not, the courts turn a blind eye to this behaviour. Your biggest fears can become your worst realities. In the case of your child, not seeing them due to a malicious mother/ex is possibly one of the worst realities. Custody should be default 50/50. If one parent thinks the other is unfit, the onus is on that parent to prove their belief. The issue with the “better parent” supposition, is who defines “better”?
