Judges are not stupid, there are situations where judges can deviate from sentencing guidelines. According to the NYPost article, her age was 24 at the time, his age was 17 at the time, everything appeared consensual, he had no complaints to this day, her husband had no complaints as well, the only one who filed charges was his mom. Gender-based discrimination in conscription is not the subject of International Humanitarian Law, it is the subject of International Human Rights Law. It leaves room for interpretation, its acceptability depends on evolving standards of decency. United States Senate voted 85-13 for gender-equal conscription in 2016. Norway, Sweden, Denmark and the Netherlands adopted gender-equal conscription in Europe. However, progress is far and between.
