Imagine if the genders were swapped. His life would basically be ruined. Implied consent is not a thing, and never will be. If he didn’t explicitly say yes, then it is rape. EDIT: The only way for this not to be considered rape is if he was in fact awake but tired enough to where he forget he said yes. He doesn’t need to be over-the-top dramatic to say that he was raped. He was still used in a sexual manner without giving consent. He explicitly said that he knew he had sex without giving consent, so how is that not a compelling case?
