The Supreme Court defers to Congress on Defense matters, or at least that was their excuse a few years ago when what was essentially the same complaint was denied for review. I just made a comment on a current /r/AskReddit thread about gender equality and some people were made that they weren't focusing on gender equality from a women's perspective but rather had men's issues in the mix, too. I think that's just a consequence of the same traditional gender roles for men and women. Men would have to spend all day at work, whereas women, as part of taking care of the home, had to go out and get the groceries, clothing, etc., and thus spent more time out of the house in a position where they were available to shop, so the market catered towards them. Well, in the United States, it's not legally rape. Legally, the federal (and most states) definition of rape requires "the penetration of the victim". Me too, I hope all the studies we have today are accurate because otherwise, it means we're discounting a lot of other victims. It's simply a thought I had today and it made me wonder if it has had an influence on historical data. However, because we can never go back to the past, it's also possible that we'll never know if this has an affect and we have to accept studies today for what they say.

If I understand your question correctly: I think that it's a sad fact of our reality that people need to protect ourselves as such to prevent things from happening while we work to eliminate perpetrators who do bad things. Rape is a horrible thing to happen to anyone, and in an ideal world, we wouldn't have to tell anyone how not to be raped, because we'd all just let eachother live how we want to live our lives.

That does happen and that's a completely valid issue, I've seen people do that and it's completely uncalled for. However, I do think it is a valid thing to bring up when people use that story to say things like "See, this is why men are bad", "Teach men not to rape", etc. Those are generalizations of an entire gender which isn't good for anyone.

Personally, I think men should be able to forfeit away all rights and responsibilities within a certain time period, both before and after the actual birth.
