Best advice I can give is just not to care. Getting upset, yelling, screaming, hitting walls, etc doesn’t do anything and can go against you later in the process. What’s done is done and you can’t change it or go back. Start setting yourself up by getting a lawyer, separating everything that ties you together. Without a postnuptial….probably not. Unless you both agree to walk away and waive rights to income. Most states are 50/50 and will just be divided up. The 10 year military rule is somewhat false, she might be able to get 20-30% depending how long you were married and while serving. If over 10 years while married it’s probably gonna be 50% of that. If you own a home, what is it worth? That is what the lawyer is probably banking on. Sometimes they will work on the contingency of a house sale and get paid through that. But most states are 50/50 anyways so who knows. Just get a decent lawyer yourself and push for a trial date

Generally when you officially file for divorce, that starts the separation process. Which also means that say if she racks up a huge about of debt after that date, everything belongs to her and you won’t be responsible for the bills. Get everything separate now.

Best course of action I can provide is to go no contact and get the divorce done as quickly as possible. Don’t get dragged into their shambles of a life. Separate every bill and joint account with them. BPD Is so unpredictable. If she doesn’t want to sign or move the divorce process along, just schedule a trial and let the judge deal with it

Retired military myself here. I’ve heard over a dozen times in my career about the buddy who 100% has a six figure job for them on the outside. They separate and guess what, the job falls though. If your plan is to get out, cool. But while on terminal definitely have a job offer letter from the company. If you don’t, just rolling the dice at this point

Kinda yes and kinda no. While the VA payments are considered tax free and cannot be garnished like a pension check, the VA payment can still be considered as “income” by the states with possible alimony payments make off that number.

You should absolutely do this if you want to face a fraud charge and possibly perjury if the court asks about it. Being real, in todays age it’s almost impossible to hide money. There is always a trail left behind that you would have to explain and it’s just not worth it. Yes it will cost money in the divorce and yes it will suck giving her your hard earned money but you will make it back 10 fold in no time being single.

Generally if you are military and overseas it’s the place where you got married. I could be wrong though and would agree with a previous comment about seeking advice from the legal office regarding jurisdiction.

You would have to file for divorce in the state you were married in. Once the divorce was final, she would lose access to the military benefits like base access and stuff. She would also not be command sponsored anymore which means she could stay in the county but it would be at her own expense (visas, passports, living, etc) I would pull the trigger now and divorce before you have kids and before she can claim anymore retirement benefits from you if you are planning to stay in. These comments just made me think back to a friend of mine. I would always ask him if he wanted to go golfing with me….always got the I have to ask the wife and 9 times out of 10 he was always busy with stuff she wanted to do. On the odd occurrence that he was able to play….the phone calls were every 10 minutes asking how much longer….what time he will be home. I could see it on his face how annoyed he was that he couldn’t even get away for 3 hours once a month.

I can’t tell you how many times I’ve seen a wife bitch and moan about their husband in the military. Their career is going good and then all of a sudden they are separating. But of my duties was to show them both sides of the fence and it’s always the spouse wanting to leave. Then you hear through the grapevine that they divorced 6 months after leaving because he isn’t making as much money. I’ve also had troops turn down orders overseas because she didn’t want to go.

Like many others have posted, make sure you get a prenup if it ever gets to that point. But even with a prenup, I would suggest NEVER EVER put her name on the mortgage or deed no matter how much she asks. And a prenup can be voided so another suggestion is DO NOT pay the mortgage from a joint account. She could argue her funds went towards the house and you might be required to buy her out.
