Which is clearly insane, as ruling goe. But, reading the page -that's one case in one state, in a ruling within that state's law. It's been cited in at least one further case, and in that case the issue of non-consent wasn't the issue before the court. So, while that's evidence that it's happened once- it doesn't appear to be a common or widespread issue in the way that many are making out.

The father can chose to abstain from sex, to use a barrier method, to withdraw, or to only have sex with a woman he trusts and has discussed the risk of unplanned pregnancy with and agreed whether (for example) she's willing to take the morning after pill in event of a condom breaking.
