Because it's important to prevent businesses from discriminating against any kind of citizen. Of course, in this particular case, it's bullshit, but you need these cases to go through in order to draw the lines.

Yeah, I agree. In the era of information, having your accusation public is already a pretty huge punishment, and that should never happen before being found guilty. Unfortunately, that's a complex matter, because then you're saying that even if you have proof of something, you can't publish that if it concerns an alleged crime. This puts investigative journalism in a tough position.

That doesn't mean the accusation is necessarily false though. Just unsupported. What if somebody gets raped, but have no way to prove it easily. Are you suggesting they shouldn't even try to complain? Of course I'm not saying he's guilty. But there doesn't have to be a bad guy in every story.

I have no strong opinion on the reasonable sentence for that, but I agree with your points. What I was saying is that the sentencing should be made solely on the consequences of the act, not the sentence it would have resulted in if it had succeeded. These are two different kinds of crimes and two different kinds of criminals and if the sentences are the same it should only be out of coincidence. I totally agree with this reasoning. The fact is that you're only considering the actual consequences and sentencing accordingly. It's not just blindly "well he would have gotten X, so that's what she will get".

They should pay, that's for sure, but that's not how justice is supposed to work. You're comparing two crimes that are very different, and it doesn't matter that they're closely related. I mean, I know it's a stretch, but it's the same kind of reasoning as "an eye for an eye". The only reasoning that must go into the sentence is the aim to dissuade recidivism, and prevent other similar crimes. Maybe in some cases the sentence needs to be exemplary, stronger than what the (false) accusation would…

That's the point, you don't get to decide which is worse, and you don't get to decide that they deserve the exact same sentences. And I tend to agree with you as far as I'm concerned, but then again, I never got raped.

Well that's a pretty radical view of society. So she doesn't deserve to be rehabilitated? What about other criminals? I mean, sure, it's a crime and should be punished, of course. But just because this particular behavior triggers more disgust in you (probably because you're a man and can relate with the victims of false accusation) than something else doesn't mean it's worse than those other things.

But it's not the same crime... Not the same prejudice, not the same consequences. I understand the reasoning but it really shouldn't be treated as the same. But yes, it does deserve severe punishment.
