Is that supposed to be an insult? Because a person's sexual history, be it how many or how few people they've slept with, is not an insult. Because the rights of the innocent always come before the rights of the aggressor. They are different scenarios. The drunk driver is similar to why a drunk person can still rape a more drunk person. You can't get a person really drunk to trick them into signing a contract because that person is not in the right state of mind to agree to that contract. That is why a drunk person cannot consent.

If someone is too drunk to sign a contract they are too drunk to consent. You don't need to know they blacked out, just that they are pretty drunk. That's easy to tell. There can be none verbal consent but that isn't great to rely on as it is easy to misread people. I always asked for affirmative consent before the first time I had sex with someone.
