I couldn't agree with you more. It isn't fair. It's legal and he's responsible with his usage. That said, and this is admittedly anecdotal, but the courts seem to find any reason to side with the moms in these cases.

I appreciate you taking the time to respond. I tend to think that it's always an uphill battle for the father in these cases. He's an exceptional dad, I'm just hoping for the best I suppose.

Regarding the spousal support, maybe just wishful thinking on my end. They haven't been married all that long and he doesn't make all that much. Plus, she young and able. It stands to reason that she can support herself. But again, I am ignorant when it comes to the legal system. If I'm wrong, tell me. Also, SAHM? What does this stand for? Regarding the marijuana, in my opinion he is responsible with it. He does it after hours (when the kid is asleep) and smokes outside.
