I would not say there is a real average cost of a divorce. If you each dig your heels in and fight over everything with lots of motions it will be very expensive. People say lawyers want to drag out the process. That is not true. They want it over with. There is no shortage of divorce work.

Start the selling process now. No need to wait. You don’t need to move to sell it. The money from the sale will go into an account controlled by the lawyers until the divorce is finalized. If you both agree, the funds can be dispersed with the judges approval. If you need to get out to close the sale find some place to live. Don’t keep paying on the mortgage. You need a clean financial break. The house is just another asset like retirement accounts, cars, and investments. The car can be in your name but if it was acquired after you married and you do t have a prenup you have equal ownership. If someone keeps the house the other gets more of the other assets. Do you have ANY assets to fight over? House, 401k, investments, savings all are fair game to be split. Even if you came in will a big hunk of money and then commingled it is now a marital asset. Alimony is not going to be much of a factor if you have only been married for 5 years. Unless there is a big difference between you and her. My divorce was the exact same scenario. Ex could have filled at a court a few minutes from our house. The whole process would have been faster and cheaper. Instead her lawyer talked her into filling first in downtown chicago. It just raised costs and dragged it out an extra year just to achieve the same result.

Working out ahead of time is always cheaper. Filling cost money. Then it may push the process in the direction of fighting it out in the courts between lawyers. If you have no kids divorce is pretty much a negotiation on how to split up assets and agree on support (ie alimony). You you both make the same amount then support is not a factor. You have some control. You can control where the case is filled. Meaning maybe a county or jurisdiction in your area could be more beneficial to you. Or you can prepare finances or other matters ahead of time. Maybe you can hide money or something. Making dumb moves like cashing out your 401K or bank accounts hurts you in the long run. Learn as much as you can about your state’s divorce laws as quickly as possible. Your laywer is not supposed to be your pal or therapist. Part of their job is to get you over the finish line with an acceptable agreement. Don’t be afraid to tell your laywer NO. Don’t take a scorched earth approach to divorce. Also try to recognize if the opposing side is thinking that way.

Keep in mind that you are not giving up half. Most Courts will view her contribution as a stay at home mother and wife as equal in value to what you earn. Unless you are a very high earner and high net worth. You will be paying alimony and child support so just accept it. You just want a fair end result. Google Ohio alimony rules. Some states are very straight forward calculations. Since Ohio is a no fault state the judge will not care who did what. She may have cheated but can say you were neglectful and drove her away. No fault states want eliminate that arguing so divorces can be finished faster. Financial malfeasance comes into play if you need to divide assets accumulated or commingled during the marriage.

Then Change your bank accounts, hide any precious things she may steal, copy all your records, figure out your kid situation, etc. then sucker punch her with papers. It is not like you will get more or get to preemptively kick her out. Like Amy court case, the defendant gets to defend themselves and respond to motions.

Yes you can. If you got custody you could get both. It will depend on you state laws. From an alimony perspective, 11 years is not very long but that’s long enough to get multiple years. It also depends on the income difference. If you make 50 and she makes 60 you not getting much if anything. If she makes 2-3x you then you might be suprised.

Start separating your finances immediately. If you have a joint account. Empty it or at least take half. Remove her as a beneficiary on your accounts. If you direct deposit a paycheck into an account she has access to. Change the account. Don’t do anything impulsive like buying a corvette or draining your 401k. My laywer said dudes have a tendency to do that. It hurts you big time when it comes to finalizing the financial deal. If she does these things it will hurt her. You pretty much can’t hid…

I was in your boat 6 years ago and made some mistakes. Sell as much of your “stuff” as you can. Just keep the essentials. Rent an apartment or town home for 6-12 months. 12 months passes fast. Figure out what you want to do next in life. Then make a move. If possible, treat yourself to something. A nice trip, a new car…anything. Don’t be afraid to rent. The freedom of not worrying about anything will be very nice for a while.
