Woah ok first time I’ve heard of this happening, and I know a lot of people who have divorced as well as getting my own legal advise! Scary. Appreciate the warnings though, I’ll see what happens when we get to that discussion soon. I just want a clean break man, is it really that much to ask for? Eugh, women.

Thanks for replying - I have had a solicitor appointment recently. They advised that spousal maintenance wouldn’t apply to our situation, and child support would be £0 as we would have a 50/50 custody split.

Well isn’t it something we can try to agree to and have a consent order in place to enforce? Also my lawyer said that 50/50 equals no child support payments

Is that legally enforced or advised though? Sounds crazy to me. My lawyer said 50/50 custody means no child maintenance, and spousal support payments are pretty much non existent anymore, in the exact same custody split you’ve got there

For sure thanks - I just know she’ll outright refuse my proposal to buy her out, take any furnishings she wants to have a head start in her new place, and I’ll even pay and help her move it all out.

At least the house got sold, and you weren’t kept tied to her financially. Not sure how accurate it could apply to me as I’m not in the USA though, but I’m happy for you!

I’m with you. She’s just generally been acting like it’s a done deal already, where I move out, have less custody, pay her child maintenance, and my equity comes in the future ‘at some point’.

Sorry yes you’re right there, it’s based on nights mainly but can also involve if either of us are more involved with taking kids to things like hospital appointments. In my case we’d be 50/50 custody nights included and also things like appointments.

Same situation as me currently, but I’m in the UK. Not sure how she can take the house away from me on top of everything else, but I’ve got my first solicitor appointment next week so that’s how I’m going to find out more about options and which way it could go if it went to court. So basically, note down all your known financials and assets etc, then get a lawyer and run through it with them. They’ve seen these situations thousands of times. I have a pro GPT licence through work, and have been using it to discuss options for splitting assets and custody etc as I’m gearing up to fight for 50/50 and the house for the sake of the kids. Yep that mesher order is my concern, as she could either use future benefits etc or a sibling to replace me on the mortgage and JUST ABOUT (maybe, doubtful though) that she can afford to keep everything going monthly like mortgage and bills and spending etc. The thing is that I’d walk away with deferred equity for god knows how long. Exactly, and I’m proposing full buy out and stay with the kids in my home, but now on the mortgage and deeds alone which I can financial do and have agreement that my mortgage broker would be happy with that. I’m just concerned that she’s going to refuse, fight me through courts, and I get shafted for my equity and the house and everything.
