You make a fair point. I personally are against both prison sentences AND death sentences. The first because it's technically forcing the victim (and all the rest of taxpayers) to pay for the perpetrator's living expenses, and that is the reverse of justice. There have been studies done on this (I don't have them handy, maybe someone else) and it was found that women on average get less severe sentences than men for similar crimes. There is a real bias in occidental courts, sometimes even by law.
