It depends on what the QDRO states, but it’s usually “as of xyz date, plus or minus earnings”

Yes there’s no hold on the 401k until they receive some sort of court document on the DRO. Granted, you can’t just take out 100% of your 401k as an active employee, there are numerous withdrawal restrictions. You’d need to leave the job before you’re eligible to cash it all out But speak to your lawyer if you have serious concerns

QDRO: qualified domestic relations order. Splits the 401k without you paying any tax/penalty.

Check with a lawyer, but I think the best thing to do is cash out what she's owed and send her a check. Take the tax hit if you need to That's horrible advice. Why take the tax hit yourself, when the QDRO splits the assets into spouse's name with no tax/penalty hit to you? OP, talk to a lawyer.
