Partners just "talking" will create grey areas, because talk is open to an individual's interpretation. You can't just say "I spoke to my partner, so I didn't sexually assault him/her". Speaking with a person, regardless of how long you do it, is not consent for sex.

"Gray areas" will appear unless both persons are specific and clear about the sex acts they both are consenting to. If a person merely says "Let's have fun in the bedroom" and the other person says "Yep, I can't wait to take your clothes off", a court may or may accept that consent to sex was communicated.

The first suggest is fine under the affirmative consent law, if they agree. The other suggestions are not. If you are already doing something, it is too late to ask whether they like it, because the answer may be no. Consent law does not consider if someone is a "caring, empathetic human being". Furthermore, consent law requires the specific acts to be consented too. To ask "do you want me?" does not make clear whether its penetrative sex or a cuddle that's wanted. And "do you want to have sex" …
