Lawyers have to defend their clients in statements and to make the opposition look bad. The article also says, "A jury will also have to decide whether the accusations made in Kesha's original court case were made "in good faith of or as a sham to defame Gottwald and obtain business leverage"." Because the article is in reference to Kesha's claim that Dr. Luke raped Katy Perry and seeing as she has no evidence of this claim, it was ruled as defamatory.
