I'll fight anybody, anytime over racist shit, even if it isn't directed at me. Violence isn't the worst thing in the world, there are things far uglier. Yeah, it just generally doesn't do any good. Hurting the other person wont change anything about them and can cause legal ramifications that haunt you for the rest of your life.

Punching can be seen as self defence tho. Not if there is no imminent threat. He could certainly argue all those points but it won't help or earn any favor.

By calling the police yes. The law doesn't allow for retaliation, only self-defense and it is no longer considered self-defense if you're no longer causing imminent threat to my safety.

I'm not dismissing what this woman did at all. I'm just telling you the reality of the law. If she was no longer creating a threat then what she did to instigate wouldn't be considered a factor in his case. And him being intoxicated would do nothing but hurt his defense. By the letter of the law they both committed battery. But, male or female battery by drink-in-face is far less likely to see punishment from the court than a punch is.

It will end the same way in court. The magistrate will laugh you out of the court room. He was under no imminent threat when he punched her and saying he was drunk isn't going to change that in any way. You can say it isn't comparable but when two things have the same result it makes sense to compare them. You were drunk, did something illegal, and now you're going to jail. The only real difference is that this guy had intent to harm, where most drunk drivers do not.

Him being drunk can confuse a situation, he didnt seek the fight, she did. Do you really think this would work as a defense? "Yes your honor, I hit that man with my car. But it is okay, I was drunk." Yeah, I wouldn't recommend trying that defense in court.

Well, you're wrong. Couldn't be more wrong, honestly. The law allows you to defend yourself. It doesn't allow you to hit someone if there is no threat. Someone can walk up, punch you in the face, and start walking away. There is nothing legally you can do in that scenario except press charges.
