The standard rule of thumb is if it is more than 1000 dollars worth of damage get the police involved. Some places / people go by the 2000 dollar rule instead. He didn't say this when he was first arrested, he only brought it up a year later in court. The defence lawyers used the fact she couldn't remember to try and drive his version of events as the truth. Regardless, he was found guilty of three counts of sexual assault. So according to the court of law she didn't or couldn't give consent.

There have been cases of a snowball effect when it comes to allegations. False memories and other motives have spurs people to include themselves in a case. There have been cases of allegations piled on to previous ones by people that haven't even met the subject of the investigation. This took place in the UK, where the age of consent actually is 16. I've done a bit more research into it since it was posted.
