Should I leave her?“Always remember women are like monkeys, they won’t let go of a branch until they have a firm hold on another.” | /r/Divorce_Men | 22/03/21 03:08 PM
Should I leave her?You think she cheated on you, abandoned you and your child, refuses to interact and has shut herself off from both of you and you’re being mean asking for custody? No. Do tests, get a lawyer, be the one that files. | /r/Divorce_Men | 22/03/21 03:06 PM
Split Legal CustodyIf she is the tie-breaker and you TWO disagree = she decides what happens. Joint + tie-breaker ONLY means she is required to make a reasonable effort to get your opinion on something. It does NOT require you two to compromise. Cases can always be modified, and if she decides to take a job in another state, you are not going to convince the court to forbid her from taking that job. Then your kids are in another state, and since she has primary physical custody YOU are required to go to her, becau… | /r/Divorce_Men | 18/03/21 06:14 PM
Split Legal CustodyThere is also a thing called "Joint custody with tiebreaker". I'm sure you can see how it's impossible to have a "tiebreaker" in a 2-person committee. That's just nice-sounding speak for sole legal custody. Remember, though it might take a little while in the courts and she might need a convincing reason, if she has sole custody she can move the kids away from you and shoulder you with the burden of traveling potentially hundreds of miles to see them. | /r/Divorce_Men | 18/03/21 12:41 PM
Quick-ish (good) court story and takeawaysThat's just this issue, the divorce should have been done a long time ago, but it was pretty damned fast. | /r/Divorce_Men | 18/03/21 12:38 PM
Quick-ish (good) court story and takeawaysThank you for considering whether it's compromising. It hasn't, but it should have settled a long time ago. | /r/Divorce_Men | 18/03/21 01:39 AM
Quick-ish (good) court story and takeawaysI agree 100%. I will always say the same thing, but of course when I was put into that situation, I realized just how much _intense focus and presence of mind_ it takes to stick to that. I spent about 5 minutes telling myself not to say anything, but cops are trained for this and fear got the better of me, at least I was cognizant enough of the situation to compose myself and vet everything before I spoke. I would advise anyone, everyone, in such a situation to shut up and get a lawyer, and only… | /r/Divorce_Men | 18/03/21 01:37 AM
